Tubsly LLC Rental Agreement and Liability Release

Tubsly LLC ("Tubsly") has entered into a rental agreement with the undersigned ("Customer") for the rental of the equipment identified above. The Customer acknowledges and agrees to the following terms:

1. Instruction and Operation. I confirm that I have been instructed on how to operate the hot tub and understand how the system works. I have received satisfactory answers to all of my questions regarding its use. If at any time I feel the hot tub is not performing properly, I will stop using it and contact Tubsly immediately.

2. Health and Medical Risk. I understand that use of the hot tub poses certain risks and dangers to personal safety. I represent that I have consulted, or have knowingly chosen not to consult, my physician regarding any medical conditions or pregnancy that could make use of the hot tub unsafe. I take full responsibility for determining my own and my guests' fitness to use the hot tub.

3. No Use While Impaired. I agree that I will not use the hot tub, and will not permit any guest to use the hot tub, while under the influence of alcohol, drugs, or any substance that could impair judgment or reaction.

4. Electrical Safety. I understand that electrical appliances must not be used near the hot tub and doing so is potentially lethal. The hot tub is supplied with an integrated GFCI-protected power cord. I confirm that a properly grounded standard household outlet is available within reach of the setup location and that the outlet is on a circuit capable of supporting the hot tub's load. I will not modify or splice the power cord, and I will not use any extension cord that has not been provided or approved by Tubsly.

5. Supervision and Occupancy. I understand that the area around the hot tub may be slippery and that extreme caution must be used when entering and leaving. I agree not to allow anyone under the age of twelve (12) to use the hot tub without direct adult supervision. I will not exceed the maximum occupancy listed for each unit in the Equipment Rented table above.

6. Structural and Surface Responsibility. I agree that the hot tub cover must be in place and secured when the tub is not in use. I understand that when filled with water and occupied, each hot tub may weigh up to the amount listed in the Equipment Rented table above (up to approximately 3,000 pounds for a Softub Resort 300). I am responsible for ensuring the installation surface — whether ground, deck, patio, or interior floor — is structurally adequate to support that load. Tubsly shall not be responsible for any damage to decks, lawns, driveways, landscaping, flooring, or structures resulting from placement, usage, or removal of the hot tub.

7. Water and Drainage. I understand that water may spill or overflow from the hot tub during filling or use and could damage nearby surfaces. I am responsible for preventing such damage. I am responsible for providing water to fill the tub at the start of the rental.

8. Freezing. I understand that freezing water can cause severe damage to the hot tub and pump assembly. I agree to maintain the hot tub in an operational and heated state at all times when ambient temperatures may approach or fall below freezing, and I accept full responsibility for any damage resulting from failure to do so.

9. Water Quality. I acknowledge that maintaining clean and safe water is my responsibility. I agree to follow the chemical and sanitation instructions provided by Tubsly and to report any water clarity or odor issues immediately. I agree not to add soaps, bath oils, lotions, bath bombs, or any other substances not approved by Tubsly.

10. Reporting. I agree to report any injuries, malfunctions, or unsafe conditions involving the hot tub to Tubsly immediately.

11. Release of Liability. I hereby release and hold harmless Tubsly LLC, its owners, members, agents, and employees, as well as Softub Inc., its owners and agents, from any and all liability for injuries to persons and/or damage to property arising out of the use or rental of the hot tub, whether the injuries or damage are to myself, my guests, or any other person, and including claims based on negligence. I agree not to make any claim against Tubsly LLC or Softub Inc. related to the use or rental of the hot tub.

12. Indemnification. I agree to indemnify, defend, and hold harmless Tubsly LLC and Softub Inc. from any and all claims, damages, losses, and expenses (including reasonable attorneys' fees) brought by any third party and arising out of my use of the hot tub, my guests' use, or my breach of this agreement.

13. Damage and Theft. I agree to be liable for all damage, theft, or destruction of the rented hot tub and accessories. The credit card on file from my booking may be charged for the cost of repair or replacement. I agree to pay any balance owed within fifteen (15) days of invoice. Tubsly will drain the hot tub at the time of pickup; I agree to provide reasonable access for drainage on the property.

14. Access and Late Return. If the hot tub cannot be picked up on the scheduled return date due to lack of access, refusal, or any other cause within the Customer's control, I agree to pay an additional rental fee of $100 per day until pickup is completed, charged to the credit card on file.

15. Cancellation. Cancellations are governed by Tubsly's cancellation policy, which is incorporated by reference: full refund if cancelled more than 72 hours before the scheduled delivery time; no refund if cancelled within 72 hours of delivery, but rescheduling within 60 days is available subject to availability. If Tubsly cancels the rental for any reason (weather, equipment failure, etc.), the Customer will receive a full refund or, at the Customer's choice, rescheduling at no additional cost.

16. Acknowledgment and Signature. I acknowledge that the electronic checkbox I provided when completing my booking confirmed my initial agreement to these terms. I further understand that this agreement must be signed in person by an adult resident of the delivery address at the time the hot tub is delivered. I agree that an electronic acknowledgment, digital signature, or in-person signature constitutes a valid and binding signature with the same force and effect as a handwritten signature.

17. Governing Law. This agreement shall be governed by and construed under the laws of the State of Michigan. Any legal action or proceeding arising under this agreement shall be brought in a court of competent jurisdiction within the State of Michigan.

18. Severability. If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement. This document constitutes the entire agreement between the parties regarding the rental of the hot tub and supersedes any prior agreements or understandings.
